Ripple Effect Wave Challenge (REWC) – Terms and Conditions 

  1. Introduction

These Terms and Conditions govern the Ripple Effect Wave Challenge (REWC) ("the Challenge"), organised by Ripple Effect Foundation Ltd (ABN 29 672 223 335) ("the Promoter"). 

Ripple Effect Foundation Ltd is a registered health promotion charity with the Australian Charities and Not-for-profits Commission (ACNC) and an endorsed Deductible Gift Recipient (DGR). 

By registering for or participating in the Challenge, you agree to comply with these Terms and Conditions. 

 

  1. The Challenge
  • The Challenge will begin on 1 April 2024 and end on 30 April 2024
  • Fundraising activities for prize eligibility must be completed by 30 April 2024, and funds must be banked before this date. 
  • Donations will be accepted until 31 May 2024

 

  1. Registration
  • To participate, you must complete the online registration form at https://rewc.com.au
  • Participants must be at least 18 years old or have parent/guardian permission if under 18. 
  • You must ensure all personal information provided (name, email, phone number) is accurate and up to date. 
  • By registering for the challenge you agree that we will collect your information and use it to contact you, we will handle your information in accordance with our privacy policy

 

  1. Fundraising and Donations

4.1 Fundraising Compliance 

Ripple Effect Foundation Ltd holds fundraising licences in all Australian states and territories where required by law. Participants do not need to obtain separate approvals to raise funds for the REWC Challenge. 

However, participants must: 

  • Comply with the conditions of REWC’s fundraising licences, including accurately representing the Challenge and its purpose. 
  • Avoid misleading or deceptive conduct when soliciting donations. 
  • Ensure that all funds raised are processed through the official REWC website or approved payment platforms. 

The Promoter reserves the right to suspend or remove any fundraising activity that breaches these Terms and Conditions or applicable fundraising laws. 

4.2 Donations & Refund Policy 

  • All donations are final and non-refundable once processed and forwarded to the beneficiary. However, in compliance with Australian Consumer Law, refund requests may be considered if: 
  • A duplicate transaction was processed. 
  • A fraudulent transaction was identified. 
  • A technical error resulted in an incorrect donation amount. 
  • Refund requests must be submitted in writing within 14 days of the transaction. 
  • The Promoter is not responsible for chargebacks or disputes initiated through third-party payment providers (e.g., PayPal, Visa, Mastercard). These disputes must be handled directly with the donor’s financial institution. 

 

  1. Terms of Use for the Website

Participants must not

  • Modify, hack, reverse engineer, or tamper with any part of the website. 
  • Engage in activities that violate Australian privacy or cyber laws (Privacy Act 1988 (Cth))orcybercrime laws (Cybercrime Act 2001 (Cth)). 
  • Upload content that infringes on intellectual property rights. 
  • Use the website to send spam or conduct fraudulent activities. 

If a participant violates these terms, the Promoter reserves the right to suspend or terminate their access. 

 

  1. Privacy Policy
  • The Promoter is committed to protecting your personal information in compliance with the Privacy Act 1988 (Cth). 
  • Personal data is collected only for Challenge administration and communication. 
  • Data Security: Personal data is stored on secure servers and protected from unauthorized access. 
  • International Users: If participating from outside Australia, you acknowledge that your data may be transferred internationally and processed under Australian privacy laws. 
  • The Promoter does not sell or rent personal data but may share it with third-party service providers (e.g., payment processors). 
  • Participants can request access, correction, or deletion of their data by contacting the Promoter. 

 7. Competition Prizes

  • 7.1 Eligibility 

    • Prizes are only open to participants located within Australia who complete their registration for the Ripple Effect Wave Challenge (REWC) and receive at least one donation to their fundraising profile between 1 April 2024 and 30 April 2024. 
    • To be eligible for the Custom Surfboard Prize, valued at AUD $1,195, participants must receive at least one donation to their fundraising profile during the Challenge Period. 
    • Some additional prizes that may be introduced during the Challenge Period may require participants to receive more than one donation to their fundraising profile. Eligibility criteria for these prizes will be clearly outlined on the official REWC website (https://rewc.com.au) and associated promotional materials. 
    • The Promoter reserves the right to add new prizes at any point during the Challenge Period. 

    7.2 Prize Notification and Claiming 

    • Winners will be notified via email within 10 business days of the conclusion of the Challenge. 
    • To receive a prize, winners must provide a valid Australian postal address to the Promoter within 7 days of notification. 
    • Prizes will be dispatched to the address provided by the winner. The Promoter accepts no responsibility for prizes that are lost, damaged, or delayed during transit once dispatched. 

    7.3 Unclaimed Prizes 

    • If a winner does not provide a valid postal address or claim their prize within 14 days of notification, the Promoter may: 
    • Conduct a redraw in accordance with applicable trade promotion laws; or 
    • Donate the prize to a registered charity. 

    7.4 Liability & Indemnity 

    • The Promoter is not liable for: 
    • Any injury, loss, or damage arising from participation in the Challenge or the use of any prize. 
    • Technical failures, delays, or disruptions related to prize notifications, claims, or delivery. 
    • Any tax implications that may arise from accepting a prize. Participants should seek independent financial advice if this is a concern. 
    • By participating, entrants agree to release and hold harmless the Promoter from any liability, claims, or damages resulting from their participation in the Challenge or the acceptance or use of any prize. 

    7.5 Prize Modification & Additional Prizes 

    • The Promoter reserves the right to: 
    • Modify the prize terms and conditions at any time, including adding additional prizes during the Challenge Period. 
    • Update the REWC website with details of new prizes, eligibility requirements, and selection processes as necessary. 
    • By continuing to participate in the Challenge, participants agree to the modified terms. 

    7.6 Governing Law 

    • These prize terms are governed by the laws of Queensland, Australia, and participants submit to the exclusive jurisdiction of the courts of Queensland. 

 

  1. Liability & Indemnity

8.1 Updated Liability Clause 

Participation in the Challenge is at your own risk. The Promoter is not liable for: 

  • Any injury, loss, or damage arising from participation. 
  • Technical failures, website issues, or processing delays. 
  • Any third-party actions (e.g., fraudulent donations, website misuse). 

8.2 Indemnity 

Participants agree to indemnify and hold harmless the Promoter from any claims, damages, or legal actions arising from: 

  • Their participation in the Challenge. 
  • Any fundraising activities conducted on their behalf. 
  • Any breach of these Terms and Conditions. 

Nothing in these Terms limits consumer rights under Australian law. If liability cannot be excluded, the Promoter’s maximum liability is limited to re-supplying services or reimbursing reasonable costs. 

 

  1. Dispute Resolution

If a participant disagrees with a decision made by the Promoter regarding the Challenge (e.g., refunds, eligibility, prize disputes), the following dispute resolution process applies: 

  1. Written Complaint: The participant must submit a written complaint via the contact form on https://rewc.com.au within 14 days of the disputed decision. 
  1. Internal Review: The Promoter will conduct an internal review of the complaint and respond within 10 business days. 
  1. Escalation: If the issue remains unresolved, the participant may seek mediation through an independent dispute resolution provider. 
  1. External Appeal (if required): If mediation does not result in a resolution, the participant may lodge a formal complaint with the relevant consumer protection body (e.g., ACCC, Fair Trading NSW). 

This process does not affect the participant’s rights under Australian Consumer Law. 

 

  1. Governing Law

These Terms and Conditions are governed by the laws of Queensland, Australia. Participants agree to submit to the exclusive jurisdiction of the courts of Queensland. 

The REWC website is accessible worldwide, but the Promoter makes no guarantees that its content complies with laws outside Australia. 

 

  1. Amendments

The Promoter reserves the right to modify these Terms at any time. Updates will be posted on https://rewc.com.au
